Agreement and scope
These terms apply to Kade Networks internet, broadband, fibre, wireless, hotspot, PPPoE and related services. Applying for, paying for, activating or using a service constitutes acceptance of the applicable service agreement. Read these terms together with your selected package, written service offer and the related policies below.
Definitions
- Subscriber means the individual, company or organisation holding the service account.
- Account means the subscriber record used for registration, authentication, billing and support.
- Services include connectivity and any voice, security, hosting, cloud or managed-network services supplied under your order.
- Equipment includes routers, switches, ONTs, radios, antennas, power supplies and fibre equipment. Network includes the infrastructure used to provide services.
- An unauthorised technician is a person not approved by Kade Networks to install, repair, relocate or modify its equipment or systems. A material breach is a serious breach that may justify suspension, termination or lawful enforcement.
Registration and account responsibilities
Provide accurate identification, contact and registration information, keep it current and have the legal capacity or authority to enter the agreement. False, incomplete or fraudulent details may result in refusal, suspension or termination of service.
Protect your account, PPPoE credentials and Wi-Fi passwords, secure your equipment, report faults and comply with applicable law. You are responsible for activity through your account, except where you demonstrate unauthorised activity beyond your control.
Service availability and speeds
Kade Networks makes reasonable efforts to provide reliable service. Unless a separate signed service-level agreement states otherwise, connectivity is provided on a best-effort basis and uninterrupted availability is not guaranteed.
Advertised speeds are “up to” speeds. Actual performance may depend on network conditions, Wi-Fi range, customer equipment, the destination service and upstream connectivity. Maintenance, equipment faults, fibre cuts, power failures, third-party infrastructure, government action, security incidents and events beyond reasonable control may interrupt service. See the Fair Usage Policy.
Charges and payments
Pay the installation, subscription, equipment, reconnection, project and additional-service charges applicable to your order when due. Check account and payment details before sending funds. Payments to an incorrect third party are not automatically credited to your account.
Non-payment may lead to restriction, suspension, termination or lawful debt recovery. Outstanding balances remain payable after termination. Disputed reversals, chargebacks and suspected payment fraud may be investigated; service may be restricted while an account discrepancy is reviewed.
Equipment, installation and third-party work
ISP-owned fibre, splitters, cabinets, poles, towers, routers, ONTs, radios, antennas and switches remain Kade Networks property unless a written sale or other agreement states otherwise.
Only authorised personnel may install, repair, relocate, reconfigure or maintain ISP-controlled equipment. Do not allow third parties to alter authentication, router or ONT settings, move termination points, splice fibre or relocate antennas without approval. Damage or interference may lead to suspension and recovery of reasonable inspection, restoration, labour, contractor and replacement costs, where legally recoverable.
Credentials, resale and network protection
PPPoE and other service credentials are personal to the authorised account. Do not sell, rent, publish or transfer them, bypass authentication, clone GPON/ONU serial numbers or LOID credentials, or access another account.
Reselling bandwidth, operating paid hotspots, splitting service to unauthorised users or extending connectivity beyond approved premises requires written authorisation. Network security, fraud and conduct requirements are detailed in the Acceptable Use Policy.
Refunds and service credits
Refund eligibility, exclusions and downtime compensation are described in the Refund Policy. A temporary interruption does not automatically create a cash-refund entitlement. Any applicable statutory rights or express service-level commitments continue to apply.
Discretionary credits are non-cash, non-transferable and subject to their stated validity. Credits issued in error or obtained fraudulently may be withdrawn.
Vouchers, rewards and referrals
Vouchers must be redeemed within their stated validity. Unused or expired vouchers are not automatically reinstated or exchanged for cash. Fraudulent, duplicated or unauthorised resale vouchers may be cancelled.
Promotional benefits, loyalty points and referral rewards are governed by their published offer conditions. Earning, redemption, expiry and programme availability may change or end subject to applicable law and the terms of the offer. Points are not cash or a proprietary interest in Kade Networks.
Self-referrals, duplicate identities, manipulated accounts and other attempts to obtain rewards dishonestly may result in withheld or reversed rewards and account investigation.
Suspension, termination and emergencies
Non-payment, fraud, network interference, unauthorised resale, serious misconduct or other material breaches may lead to warnings, credential resets, service restrictions, suspension or termination. Immediate disconnection may be necessary to protect the network, prevent cyberattacks or fraud, or comply with a lawful requirement.
Kade Networks may preserve relevant evidence and seek lawful recovery of losses, court orders or referral to competent authorities. Legal costs, damages and other amounts are recoverable only where permitted by law or awarded by the relevant authority. Honest reviews and lawful complaints are protected as explained on the Abuse reporting page.
Information and evidence
Account, authentication, billing, security and support records may be used to investigate faults, fraud, disputes, litigation or lawful regulatory requests. Information handling is described in the Privacy Policy. Evidence preservation does not mean every type of record is collected for every service.
Liability and events outside our control
To the extent permitted by applicable law, the service terms exclude indirect or consequential losses, including lost profits, business, contracts, customers, opportunities or data, and limit liability to the amount paid for the affected billing period. These limitations do not exclude rights or liabilities that cannot lawfully be excluded.
Disruptions caused by events beyond reasonable control are subject to the service agreement and any applicable service-level terms.
Changes, transfers and governing law
New products, technologies, billing methods, authentication systems and reward platforms may be introduced or modified, subject to applicable law and required notification. Account transfers, including requests following a subscriber’s death, require appropriate authority and supporting documentation.
The service agreement and applicable written offer constitute the agreement for their subject matter and supersede prior communications on that subject. Kenyan law governs the agreement. Raise a dispute with our team first; nothing in these terms prevents lawful regulatory complaints or access to competent courts.
Activation and access
Connection requires coverage and technical confirmation, agreed payment and reasonable premises access. Confirm installation timing with our team.
Equipment care and return
Report equipment loss, theft or faults promptly. Protect installed equipment and arrange authorised inspection or collection. Warranty cover follows the applicable supply terms and statutory rights.
Billing periods and deposits
Your order determines renewal dates, expiry, rollover and any deposit. A deposit is payable only if expressly agreed; its return follows that agreement and applicable law.
Customer cancellation
Contact support to cancel and confirm the end date, outstanding charges and equipment return. Ending service does not erase accrued rights or liabilities.
Third-party internet services
Maintain compatible devices, backups and security software. External websites and applications have their own terms; connectivity does not guarantee their availability or safety.
Notices and resolving concerns
Keep your contact details current. Request clarification of changes or maintenance notices. Send billing disputes with payment references and service complaints with fault details; regulatory and court remedies remain available.
